1. Purpose and scope
These Terms of Use govern access to and use of the Zehemi platform (zehemi.app), operated by MPPA, and the institutional website mppa.africa. By using these services you unreservedly accept these terms. MPPA reserves the right to amend them at any time.
2. Definitions
'Platform' means the zehemi.app website operated by MPPA. 'MPPA' means the operating company. 'Project owner' means any person or entity creating a campaign. 'Donor' means any person making a donation. 'Account' means the personal space created upon registration.
3. Registration and account management
Creating a project-owner account is reserved for adults or legal representatives of legal entities. You are responsible for the confidentiality of your credentials. Any activity carried out from your account is your responsibility.
4. MPPA's role
MPPA acts as an intermediary connecting project owners and donors. MPPA does not guarantee project completion and cannot be held liable for project owners' failure to meet their commitments to donors.
5. Fees and commissions
Use of the platform is free for donors. MPPA deducts a commission from collected funds; the rate is communicated before the campaign is created. Banking or mobile-money processing fees may apply depending on the operator.
6. Project owner obligations
The project owner undertakes to: provide honest and verifiable information; use collected funds in line with the campaign description; report fund usage to donors; and comply with applicable regulations in their country.
7. Donation and refund policy
Projects operate on an all-or-nothing basis: funds are released to the project owner only if the target is reached. On failure, donors are refunded. After the refund deadline, unclaimed funds are transferred to a solidarity fund managed by MPPA.
8. Content and intellectual property
Content published by project owners (text, images, videos) remains their property. By publishing on the platform they grant MPPA a non-exclusive licence to distribute it within the service. Content on mppa.africa belongs to MPPA.
9. Limitation of liability
MPPA's liability cannot be engaged for a project owner's failure to meet obligations, temporary service unavailability, user-caused data loss, or force-majeure events. MPPA is not a payment institution.
10. Termination and suspension
MPPA may suspend or close an account or project at any time for breach of these terms, proven or suspected fraud, or at the request of competent authorities. Users may close their account at any time via settings or by contacting support.
11. Governing law and dispute resolution
These terms are governed by Beninese law and applicable OHADA treaties. In the event of a dispute, the parties agree to seek an amicable resolution first. Failing that, the competent courts of Cotonou (Benin) shall have jurisdiction.
12. Changes to these terms
MPPA reserves the right to modify these terms at any time. Users are notified of changes by email or platform notification. Continued use of the service constitutes acceptance of the updated terms.
